James W. Hailey III is a Partner with the law firm of Lewis Brisbois Bisgaard and Smith LLP, and operates out of its New Orleans office. For over the past two decades, he has assisted his insurance and corporate clients in detecting, defeating and deterring fraud. He has handled numerous first and third party fraud/bad faith claims, including trucking/transportation staged accidents, passenger stuffing incidents, uninsured motorist defense, suspicious slip and fall and other bodily injury claims, false builder’s risk claims, insurance coverage issues, fire cause and origin investigation, illegal practice of law by public adjusters, material misrepresentations, collusion and theft.
Mr. Hailey’s SIU work includes the investigation of the illegal corporate practice of medicine, which has resulted in guilty findings and the forced closings of several medical corporations in Louisiana. He has helped several clients in pursuing civil claims against the administers and owners of these medical corporations, seeking restitution from the corporations as well as individual claimants by various theories of liability, i.e., fraud, conspiracy to commit fraud, federal RICO statutes, unjust enrichment and the Louisiana Unfair Trade Practices Act, among others. Mr. Hailey Co-authored, "Defending Against Insurance Fraud Claims", Author of featured article of CLM's Claims Management magazine, Speaker at 2013 CLM's Bad Faith Insurance Coverage Mini-Conference. Mr. Hailey has given numerous speeches for industry and client conferences addressing the best techniques to detect, deter and defeat insurance fraud. In addition, Mr. Hailey is the founding secretary of CLM's Southeastern Louisiana Chapter and a member of the Insurance Fraud Committee where he acts as Adjuster-Training Chair.
