Product Liability

The mission of the Product Liability Committee is to provide a forum for CLM Fellows and Members to exchange information related to product liability litigation and risk management; track industry developments and trends; educate product manufacturers, distributors and retailers, and the insurance industry on current legal and policy issues of interest; and, publish articles and create programs dealing with important topics relating to products liability. Both Fellows and Members are eligible for a Product Liability Committee role; however, participation on the committee by Members, as well as by Vendors, Service Providers and Consultants, is preconditioned on that Member, Vendor, Service Provider or Consultant first nominating an insurance, claims or corporate Fellow who joins the committee.

This is a reminder that we are still accepting proposals for the 2022 CLM Focus: June Conference, June 15-16 in Nashville, TN.

 
Speakers receive complimentary registration to the event, and an opportunity to gain recognition and share your expertise. The Conference also features tremendous networking opportunities to make new connections and strengthen existing relationships. This conference features tracks in Diversity Equity & Inclusion, Management Liability, Medical Malpractice, Product Liability, Professional Liability, Transportation and Claims & Litigation Management.
 
The deadline to submit is Wednesday, February 2nd.

 
Below are the suggested topics to choose from however, you are welcome to submit your own topic: 
  • Self-driving cars
  • Security systems
  • Defective medical devices
  • Taxotere lawsuits
  • How to gain the participation/contribution of manufacturers in China?
Presentations and outlines should be geared toward senior level litigation, claims, and risk professionals, and experienced attorneys. Please review the complete list of panelist/presenter requirements here.

Human Factors and Product Liability: Issues of the Present and Future - October 19, 2021 3:15 PM

Human Factors are defined as the capabilities and limitations of people as they interact with their environment. In other words, Human Factors expertise can help explain the behaviors and abilities of the parties involved in an accident, and also can help in the development of safe products to effectively avoid accidents. This session will discuss the application of Human Factors principles to the investigation and analysis of transportation incidents (including automobiles, trucks, bicycles, pedestrians), and consumer products (design, development, injuries, warnings, instructions, and training).  We also will discuss emerging advanced vehicle technologies and the corresponding human issues that come along with developing technologies. By understanding the role and influence of attention, cognition, vision, and behavior of individuals operating a vehicle, Human Factors practitioners can offer invaluable insight to the development of technology design as well as the analysis of driver behavior. Anyone involved in litigation, incident investigation, or the product development process will benefit from participating.
 
Return to Sender: Consumer Products Recall - October 19, 2021 4:30 PM

Inspired by a personal interest in recent recalls of pet-related products including food and other supplies, this panel will focus on the timely issues involved in consumer products recall. The process involved in product recall is complex. The impact on the liability of product manufacturers and suppliers, as well as claims handling professionals is vast. The process includes consumers complaints, governmental investigations, and notification to the public. Questions will arise regarding the effectiveness of the recall with the ultimate goal of relieving the manufacturer and supplier of liability and to reduce future claims. The panel is ready to discuss and debate this topic following recent high-profile recalls and potential litigation.
 
Year End Review: Novel Product Liability Verdicts - October 20, 2021 10:00 AM

Product liability law is ever changing and developing to conform to the marketplace. This round table presentation will discuss about 10 novel or significant product liability cases that have recently been decided or issued. Run-away jury verdicts, especially those that are heavy on punitive damages, but light on compensatory damages, are being given greater scrutiny at the appellate court level. The cases will be discussed for their significance and the decisions will be analyzed to determine how it could affect other product liability cases.
