Even within the segment of that universe we typically think of in the context of “professional liability,” the issues a claim handler may face can vary widely, while at the same time, there can be running themes. Management Liability (D & O, EPLI and Fiduciary Liability) products and issues occupy a world of their own, as does what is increasingly being called “Cyber Security.” This class will provide a closer look at the main professions and issues associated with the E&O “Errors and Omissions” portion of the PL universe (not including medical malpractice), and then focus on the burgeoning world of Cyber. [A separate Level 2 course addresses Management Liability.]
After completion, participants will be able to:
• Identify the main professions falling within the scope of “E & O”
• Address the recurring critical issues of privity, applicable standard of care, damages, causation (including the concept of “claim within a claim”) and the need for experts
• Discuss the main exposures/issues associated with claims against attorneys, accountants, insurance agents and architects/engineers
• Identify key Cyber exposures and understand key regulatory requirements in the event of a data breach
- Describe the various coverage features that are available for Cyber “Security” protection
