Litigation always involves valuing your case, which means making educated guesses about the future. Lawyers and adjusters often incorrectly believe that if their analysis of the substantive legal issues is accurate, their case’s valuation is as well. Unfortunately, sometimes things can get lost in translation. Why? Humans are not as good at predicting the future as we think. Behavioral psychologists believe the reason is we employ cognitive biases, which can impact litigators and adjustors as easily as game show participants. This presentation--Cognitive Bias: Its Impact on Case Evaluations and Settlement Negotiations--will discuss why certain brain teasers are so tricky and how the biases they reinforce can impact case evaluations.
