This program focuses on the risk manager and broker perspective on early litigation management. Specifically, it analyzes how the roles of lawyers, claims professionals, and insureds are interconnected with the objectives and decision-making of risk managers and brokers. A significant emerging industry trend has been the expansion of self-insured retention (SIR) policies. Driven by both insureds’ efforts to lower premiums and augment their role in the investigation, handling, and settlement of low exposure claims, the shift away from traditional insurance toward self-insured strategies has been pervasive.
This presentation focuses on identifying risk management objectives for SIR programs and implementing effective strategies during the early stages of litigation. As risk transfer efforts are implemented prior to or at the outset of litigation, an insured’s SIR will quite commonly raise an array of challenges and opportunities for problem solving. The panel will analyze these issues and contextualize them within recent legislative developments, decisional law, and their unique industry experience.
The panel will emphasize how lawyers, insureds, claim professionals, and risk managers can successfully navigate scenarios where an SIR is likely to be exhausted. Ultimately, the program seeks to promote the value of communication among these players with the goal of achieving a collaborative approach to litigation management.

In this interactive seminar the topic of how to successfully implement a construction defect alternative fee arrangement ("AFA") program in the construction defect field will be discussed. This includes the use of strategic settlement initiatives and the gathering of key data. The panel and the audience will then engage in an exercise whereby they come up with pricing for an AFA construction defect program.
