This class will look at changing the paradigm of expectations for outside counsel and explore and provide tools for claims professionals to monitor, control, and ideally reduce a variety of costs incurred in the defense of their cases. The group will discuss ways coverage/monitoring counsel and defense counsel can be evaluated and communicated with in order to find more cost efficient resolutions. There will also be discussions of various settlement strategies including a discussion of “outside the box” attempts seen and made by the instructors.

This class will provide a closer look at Employment Practices Liability Insurance (“EPLI”) and a brief overview of Fiduciary Liability

The universe of insurance products (and customers) that typically fall under the “professional liability” umbrella is wide and diverse. Even within the segment of that universe we typically think of in the context of “professional liability,” the issues a claim handler may face can vary widely, while at the same time, there can be running themes. Management Liability (D & O, EPLI and Fiduciary Liability) products and issues occupy a world of their own, as does what is increasingly being called “Cyber Security.” This class will provide a closer look at the main professions and issues associated with the E&O “Errors and Omissions” portion of the PL universe (not including medical malpractice), and then focus on the burgeoning world of Cyber. [A separate Level 2 course addresses Management Liability.]
After completion, participants will be able to:
• Identify the main professions falling within the scope of “E & O”
• Address the recurring critical issues of privity, applicable standard of care, damages, causation (including the concept of “claim within a claim”) and the need for experts
• Discuss the main exposures/issues associated with claims against attorneys, accountants, insurance agents and architects/engineers
• Identify key Cyber exposures and understand key regulatory requirements in the event of a data breach
- Describe the various coverage features that are available for Cyber “Security” protection
