Session 1 - Cyber - The Threat is Real: Managing the Cyber Risks of Third-Party Vendors

When it comes to cybersecurity risk assessment and management, there is more to consider than what might initially come to mind when reviewing an insured’s third-party vendors. Beyond the obvious risks related to potential cloud-computing or IT vendor breaches, there are risks to be considered from third-party vendors who regularly do business with an insured but play no role in information security. Panelists will examine how insurers can assess cyber risks presented from all the insureds’ third-party vendors, address how insureds can establish contribution/indemnification from third-party vendors by properly negotiating their contracts, discuss how insureds who are the subject of litigation can seek contribution from third-party vendors if there are limitations of damages or liquidated damages clauses, and touch upon potential subrogation opportunities and strategies.

Stemming from recent health studies that indicate PFAS compounds are carcinogenic, and that widespread contamination exists, state and federal governments have ramped up efforts to regulate PFAS pollution.Panelists will discuss the new PFAS-related regulations and the resulting new – and sometimes unexpected – liabilities and claims for businesses who use and dispose of products containing PFAS.

One of the first questions that claims professionals need to answer with any construction claim is: What is the exposure? Answering this question is critical to determining whether a vigorous defense is warranted or if a quick settlement is the best course of action. This question requires an exhaustive look at the coverage of all involved parties and evaluation of the allegations by claims professionals, legal counsel, and forensic experts must be performed with a clear consideration of the potential liability and options for subrogation given any contractual limitations. Through examination of real-world examples, this panel will explore the challenges and opportunities that a claims team faces when evaluating construction claims and discuss best practices for determining the extent of liability and opportunities for transferring risk.

This game-changing session is so packed with critical insights and inspiring speakers, that we had to extend it to a two-hours! For too long, persons of color and women leaders of all backgrounds have led the cause for Diversity, Equity, Inclusion, and Belonging with limited success. For exponential change to take place, the efforts must be integrated with male leaders. GOODGuys™ (Guys Overcoming Obstacles to Diversity) is a program created by the National Conference of Women’s Bar Associations to integrate DEIB efforts with male leaders. In this session, volunteer members of the GOODGuys will explain why they care about DEIB and they challenges they face championing it, as well as what's working, what's not, and how other males leaders can successully lead the charge in their organizations.

Session 4 - Property - Too Little, Too Late: Late Notice Claims + Hurricanes
In the ideal world, claims are reported promptly after the storm event, allowing an investigation to obtain the best available evidence of any property damage caused by the storm. But we live in reality and sometimes claims are reported significantly after the event, limiting the amount of information that can be reasonably obtained. This panel will walk through some proven strategies to effectively address hurricane-related late notice claims, including the critical component of when the insured knew of the damage or should have reasonably known of the damage.

Think you have the chops to tell the difference between hail damage or a manufacturing defect? Join us in this interactive workshop where you can explore and test your knowledge firsthand on hail damage, mechanical damage, and blisters on asphalt roofing shingles. Some of the results might surprise you. To help boost your skills, we also will have samples of asphalt shingles that have undergone a desaturation test so that you can observe and feel the mat fractures and related damage. We will take a deeper dive into what a desaturation test can and cannot tell us and discuss the legal and claims aspects of when testing could be beneficial.
